EU postpones due diligence implementation

On May 21, 2025, the European Commission released a proposal on battery due diligence for the new EU battery law. The key contents are as follows:

The battery due diligence obligations, originally scheduled to take effect on August 18, 2025, will be delayed by two years to August 18, 2027. The battery due diligence guidance will be published one year before the obligations take effect, and is expected to be published on July 26, 2026.

Battery due diligence requirements have been adjusted to economic operators with a net turnover of at least €150 million in the previous financial year. The frequency of economic operators publishing battery due diligence reports has been adjusted from once a year to every three years.

 

 

The main reasons for this revision are:

The battery raw material supply chain is affected by changes in the geopolitical landscape, and it takes time to analyze and adjust the supply chain;

The battery due diligence policy requires review by a notified body, and more time is needed for the establishment of third-party certification bodies:

Schemes for battery raw materials still need to be further developed and implemented before they can be approved through the battery due diligence scheme process;

Affected by the adjustments to the Corporate Sustainability Due Diligence Directive (CSDDD).

To ease the burden on some businesses and free up resources for growth and investment, the exemption will be further extended to small and medium-sized companies (SMCs), which are typically three times the size of small and medium-sized enterprises (SMEs).

 

Although the deadline for fulfilling battery due diligence obligations has been postponed, relevant companies still need to make preparations in advance to ensure that they meet the battery due diligence requirements and complete the review by the notified body before August 18, 2027.
