Regulation Update | Brazil’s New Fixed Lithium Battery Rule Ato No. 5314 Is About to Be Enforced

As the Brazilian telecom sector continues to expand its energy storage needs, ANATEL issued Ato nº 5314/2026 on April 14, 2026, formally establishing the technical requirements and test procedures for the certification of Lithium Secondary Batteries for Stationary Applications (including BMS). This new regulation will directly impact all products destined for the Brazilian market, such as communication backup power supplies, base station energy storage batteries, and UPS compatible battery systems. Mandatory enforcement begins on October 12, 2026.

Application Scope:

Ato nº 5314/2026 applies to stationary lithium-ion secondary batteries installed in communication equipment operating under high or medium discharge intensity conditions, provided they simultaneously meet the following criteria:

  • Stationary secondary lithium-ion batteries

  • Nominal voltage: 24V or 48V

  • Design life ≥ 10 years (float charging at 25°C)

  • Intended for power supply or backup power to telecom equipment

Note:

  • The battery must incorporate a BMS that meets functional requirements for communication, protection, and monitoring.

  • Applicant&certificate holder: The certificate must be held by a locally based Brazilian company.

Testing standards:

Ato nº 5314/2026 mandates the following standard framework for all testing:

  • ABNT NBR 16975:2021 – Electrical testing

  • ABNT NBR 16976:2021 – Safety testing

  • BMS communication: Must support MODBUS protocol, providing data on voltage, temperature, SOC, SOH, alarm status, and more.

Certification Renewal Cycle:

This certification follows a type-approval model. After the certificate is issued, a periodic review of both the product and the production management system is required every three years to ensure ongoing compliance with the regulatory requirements.
